Native Americans in Canada who were born in Canada and are members of Canada’s First Nations are allowed to freely cross the US/Canada border under the terms of the Jay Treaty so long as they don’t have a criminal history. However, if the native citizen living north of the border has a criminal conviction on their record, then US Customs and Border Protection officers could stop them from entering the country. Accordingly, if you are a First Nations person with a criminal past, you will still need a US Waiver to enter the United States.
